Has your standard rules permit changed?

On the 18th of December 2024 the ‘Environment Agency’ realised a series of ‘new’ consolidated standard rules permits, which replace a number of older standard rules, which now have been withdrawn.

Below we have provided a table showing the activity description, permits which have been withdrawn, the new consolidated permit applicable and updated technical competence requirements which have changed for some activities to reflect the inclusion of hazardous waste.

Quick fire question and answer!

The Environment Agency has issued a Regulatory Position Statement (RPS), specifically RPS 331. This changes the original compliance window from the 18th of March 2025, to the 27th of June 2025.

Q) I have read through the new standard rules permit applicable to me and I cant adhere to the rules within it, what do I do?

A) If you cannot comply with the new standard rules permit you will need to apply to vary your permit into a bespoke permit. You must apply for a bespoke permit by 27th June 2025 and continue to comply with your standard rules permit.

Q) I have reviewed my technical competence against the new standard rules permit for my facility using the table below, and I require an additional qualification / or units. Do the EA expect me to achieve this by the 27th of June 2025?

A) No, the Environment Agency has put in place a 'Regulatory Position Statement (RPS)', which was issued on the 13th of March 2025, and provides anyone affected 12 months from the date the RPS was published to achieve any additional units or qualifications.

Q) I have reviewed the new standard rules permit applicable to me and I can adhere to it, is their anything else I need to know or do, other than reviewing my technical competence?

A) As required by rule 1 within any standard rules permit, you need to operate in line with a written management system more commonly known as an Environmental Management System or EMS. This should be readily available to site staff and regulators on request.

This will need to be reviewed to consider any changes to the permit and associated operating techniques. We have also provided an additional link below to the non-hazardous and inert waste: appropriate measures which is linked to the majority of these new standard rules permits.

Note : New permits such as the ‘SR2022 No4’ and ‘SR2022 No5’ are listed twice within the table, both as a high and medium risk operations.

This is to reflect the fact that not all sites will opt to accept asbestos. Therefore, anyone accepting asbestos will need to meet the requirements of the high-risk listing; anyone not accepting asbestos will need to meet the requirements of the medium-risk listing.

Do you operate an exempt waste facility?

Do you operate an exempt waste facility, such as a T9 or S2 among others, do you have someone employed or contracted in who has the required technical competence to legally manage your exemption?

Over the last 12 to 14 months, we have seen an upsurge in exempt site owners being talked into requiring technical competence cover at great expense, with a notable upsurge since the consultation on exemptions and associated changes was published earlier this year (For more information on the changes to exemptions, visit the link to read our blog: https://www.hsecservices.co.uk/waste-exemptions-consultation-outcome-supplementary-government-response-updated-6-february-2023 ).

So, if you manage an exempt facility or know someone who does, even if it’s an exemption which is due to be removed within the next year or so like the T9 and you are planning ahead and applying for a permit, you do not need anyone with the required technical competence and if your being told you do, your probably being ripped off!

You only require technical competence if you’re managing a permitted facility!

Now it’s always good to plan ahead, get costs, even start the required qualification, possibly even complete it depending on the route, access to a surrogate site and other factors if you’re applying for an environmental permit to help spread the cost or avoid the need for temporary cover once the permit is issued and operational, but you don’t need external cover if as above your operating an exempt facility!

So far, we have seen a bit of a trend in that the majority of sites are dealing in scrap metal, and some appear to have decided to apply for a permit or they are in the early stages and looking to apply for one due to the pending changes to various exemptions!

People are abusing the system to make money and con people, who are possibly unsure of what’s required!

So here are some quick tips to ensure you don’t get scammed!

If approached even if your concerned by what you have been told such as a change in requirement, don’t panic, don’t agree to anything, don’t allow yourself to be pressured, say to them you will think about it and come back to them!
Seek advice from a number of reputable sources such as CIWM (WAMITAB) or one of their centres, consultants, the Environment Agency or Natural Resources Wales.
Once you have all the facts, you can then make an informed decision!
Talk about it, speak with friends, colleagues and others, share this blogg or social media post so we can raise awareness!

Tips for those operating a permitted facility, who may require temporary technical competence cover (Also referred to as COTC or TCM cover):

Always check the individual’s certification is legitimate and suitable for your facility, with social media being at the centre of so many peoples lives, people regularly share their achievements including certificates, so copies are easy to obtain, people are more aware of how to use picture editing software and the risk of fake certificates is likely to increase regardless of the sector or industry! You can check a CIWM (WAMITAB) certificate by scanning the unique QR code available on the back of the certificate, or email info.admin@ciwm.co.uk and they will provide advice and tell you what they need to confirm the certificate as being legitimate! This along with checking a legal form of ID, will ensure the person providing the cover is suitably qualified and is the person stood on site! Also don't forget to ask for their continuing competence certificate, if the original certificate is more than two years old!
If you don't know the attendance requirement for your facility, speak with your local Environment Agency or Natural Resources Wales officer, to ensure the person providing cover is able to attend site for the required amount of time, this also ensures your not paying for more than you require, or paying for cover and still falling short of any attendance requirement!
Get references or do some research, do they have a good reputation, has anyone else you know used them?
Be careful when dealing with individuals or organisations who provide you everything directly, be it qualifications and technical competence cover, or a mixture of services because there can be a conflict of interest, and we have seen learners we have taken on from other centres who have been on program achieving their qualification for far longer than they should, because their original assessor was also providing technical competence cover, which was far more financially lucrative and their progression was stalled, so while it might seem a cost effective solution, it’s possibly not longer term!

Is a managed training and qualifications service the real solution?

So, what is a managed training service?

It’s effectively where an organisation looks to outsource aspects of an organisations learning and development functions, using a single training provider or organisation, to supply and source all of their qualifications and training either directly or indirectly, in addition to administrative services such as reporting, updating training records, copy certificates etc.

For some, the idea of outsourcing the management of qualifications and training would seem on merit a cost-effective solution and a bit of a no-brainer, but does it benefit the entire organisation, or a few select departments, who are out of touch with the needs of sites or the issues resulting from the services provided by the managed training provider?

Some companies may offer financial incentives based on annual spending or other indicators which make the process look extremely attractive, certainly when it enables you to reduce the workload or staffing in a learning and development department!

But do the people you’re outsourcing to have direct operational experience in their field, or are you outsourcing to a company which, internally, considers itself to be merely a sales and administration organisation? Which only cares about the numbers and retaining customers to hit those targets and projections?

But does this come at a cost? If you don’t have the passion for delivering quality alongside quantity, inevitably, what you are providing, whether a product or a service, is likely to be mediocre at best!

You think you’re getting a good deal, as senior managers in procurement, learning and development and other roles such as HR are getting what they want out of it, regular meetings with the managed service, the best cost during the tender, administration functions covered, so at a senior level everything looks rosy?

But what do the sites think, are the managers happy with the training provider or standard, are the site operatives and supervisors happy, or are they being left with no support? Are you as compliant as you should be for the size of your business?

This year more than ever, has seen a surge in sites within larger organisations contacting us because they don’t want to use their companies chosen supplier, as they have seen the poor service others within the business have received, courses cancelled or moved, learners being left for long periods with little or no contact, no offer of support, nowhere to turn to possibly because the managed services relies more on schmoozing the people at the top, than it does ensuring quality training and assessment in the high-risk operational areas of the business?

A common problem we are seeing is learners progressing slowly or not at all because they don’t hear from their assessor, the centre or anyone else for long periods of time.

Trainers spending less time than you would expect on-site, turning up at 08:00 hrs and going just after lunch? Learners who are not progressing or able to make a start because their chosen course is regularly cancelled or re-scheduled!

Suppose sites are willing to go through approved third parties to use the training provider of their choice. In that case, you have to ask why the company is continuing to use a managed service rather than building up a pool of trusted providers who specialise in core areas and will ultimately provide better service to the sites and broader business.

Not to mention improved safety and security of knowing that the business is more compliant, and staff are more competent.

Is it because of contracts which are in place or financial incentives? There has to be a reason, but whatever the reason, it does not promote learning, compliance and positive application; how can it be if the people requiring qualifications or training are looking in a different direction to those who should arrange learning and development?

What do we offer that is different? Firstly, regardless of the business size, we have no formal contracts which tether us together or result in us being bound for an extensive period, which is the same for all our customers whether it’s an individual, medium size business, national or international PLC!

Don’t get us wrong, we have terms and conditions which set out basic principles which apply, but we believe an organisation should be able to come and go as it pleases if we are not delivering or standards are not being upheld, or you can receive a better standard else where you have a choice.

Furthermore, because there is no formal contract, we constantly strive to ensure everyone and everything we do is the best it can be because if we don’t, the customer can and will leave. Which reduces the risk of becoming comfortable which can often be a problem where a long-term contract or when collaborative working exists.

We work with many independent organisations who share our values, as we recognise no organisation can be the master of trades, so we put you directly in their hands so you get that specialist, bespoke customer experience and associated knowledge, which will adapt and react quickly to your business needs.

We also recognise that no organisation is perfect, and from time to time, there will always be an odd hick-up along the way, certainly in a new project. Still, we can guarantee any issues will be resolved swiftly and decisively because we can react quicker due to the direct involvement from the customer to the assessor, trainer and administration.

The CIWM ( WAMITAB ) Level 4 Certificate in Waste and Resource Management - VRQ.

Hello, and welcome to Health, Safety and Environmental Compliance Services Ltd.

So today we are going to look at the CIWM ( WAMITAB ) Level 4 Certificate in Waste and Resource Management.

Never heard of it? Well, that’s probably because there are only small select few centres within the CIWM ( WAMITAB ) centre network who are approved to deliver this qualification.

We thought we would start with some popular questions, that many clients ask before enrolling to achieve this qualification.

General questions with answers:

Q1. Is this qualification, suitable as technical competence for a permitted facility?

A1. Yes, this qualification is listed in the CIWM ( WAMITAB ) Operator Competence Scheme, as a suitable qualification, that will allow the individual on completion, to act as the technically competent manager of a permitted waste management facility. It suitable for a range of medium and / or low risk permitted activities.

We have provided below an example taken from the CIWM ( WAMITAB ) risk tier table for non-hazardous waste transfer and treatment, where you will clearly see the first qualification listed is the ‘’CIWM ( WAMITAB ) Level 4 Operator Competence for Non-hazardous waste treatment and transfer’’ more commonly known as ‘’MROC1’’ achieved through assessment in the working environment.

Below this you will see the ‘’CIWM ( WAMITAB ) Level 4 Certificate in Waste and Resource Management’’, followed by the qualification code, then in brackets it will have a number such as ( VRQ406 ), it’s this number which you can use to identify the appropriate optional unit required, which will become clearer, when we start to talk about the process.

Q2. How long does it take to complete?

A2 . Delegates have 12 months to achieve this qualification from the date of registration. However, the average completion time is between 3 and 5 months. It is however down to the Delegate, and we have had Delegates complete their chosen qualification in as quick as a few months.

Q3. Do I need any other qualifications?

A3 . No, this qualification is open entry which means you don't need to have achieved any other qualifications and it’s designed to support those who are both new and experienced, because it includes an in-depth knowledge training course which forms part of the process.

Q4. Do I need to be working on a waste site?

A4. No, unlike the alternative route to achieve technical competence achieved through on-site assessment, this qualification does not require you to be assessed in the working environment. This also means it can be achieved in advance of any permit application.

This qualification is not only suitable for those looking to act as the technically competent manager of a permitted waste management facility, but it can also be achieved by those in support roles such as SHE managers, waste carriers, brokers and sales teams who can apply the knowledge to assist with both compliance and customer support.

Q5. Is it transferable to any of the on-site assessment qualifications e.g NVQ, QCF or RQF?

A5 . No, this qualification is assessed differently, however there is an expanding range of optional units covering many medium and low risk activities to include but not limited to transfer and treatment of non-hazardous waste, end of life vehicles, metal recycling, contaminated land remediation, inert transfer and treatment, inert landfill, mechanical biological treatment, anaerobic digestion, in vessel and open windrow composting.

Q6. Do I need to complete the qualification before my permit is issued?

A6 . Yes, the regulator will not issue any new permit until you can provide evidence of having achieved the appropriate competence.

The process:

The course material is delivered via PowerPoint presentation; however, this will not be death by PowerPoint, this will be an interactive fun learning process, with various exercises, question and answer sessions and much more!

This course will not only provide you with the knowledge and understanding to complete the written projects required, but this will set you up in a career in waste management.

The course covers the 5 mandatory units, which are as follows:

VRQ401 - Health and safety in the waste and resource management industry
VRQ402 - Environmental protection in the waste and resource management industry
VRQ403 - Principles of sustainable waste and resource management
VRQ404 - Legislation for the operation of a waste management facility
VRQ405 - Stakeholder communication and other non-legislative factors affecting the waste and resource management industry

Each Delegate will then select at least one optional mandatory unit, which will be their specialist subject and is relevant to a permitted waste management facility.

After the course, you will be required to complete and submit a unit question paper for each of the 5 mandatory units and your chosen optional unit(s) in your own time, away from the course.

These are submitted to us electronically or through the post for marking. Should they reach the standard required, we will store them until all of your unit question papers have met the standard.

Any unit question paper(s) which do not reach the standard, will be returned to you along with feedback from the marker.

This will allow you to review the feedback provided by the marker and continue to research and learn, prior to making the required amendments to your question(s).

Once amended, they are sent back to us for marking. When all of your unit question papers have met the standard, they will go through an internal and external moderation process. After this point, we can then claim your award!

Final points!

The process to achieve this qualification, sounds rather straightforward however we must make you aware this does require the learner to apply the knowledge in their own words, and the responses required in the majority of the question papers assignments are in depth explanations or descriptions, which sit between A level and Entry level Degree.

This doesn’t however mean because you didn’t do well at school or you haven’t been in education for 20 years that you can’t achieve this award, we have had accountants entering the sector who want to run a waste site, sons, daughters and partners not currently working in the sector, but whom want to start a family business with another relative, as well as those whom English is not there first language all of which have successfully achieved this award!

Also remember, we are going to provide you lots of knowledge through our approved training course, as well as on going support, which includes attendance to the training again for FREE be it single units or days, or even the entire course if you feel it will benefit you!

Why should we choose HSEC?

We are not going to sit here and say we are the best, or the largest provider of this particular qualification, but we will advise you on some points to look out for when selecting a training provider, so you can decide for yourself!

1) Is there advice on hand, at the outset of the enquiry? Are they passionate about the sector and qualifications they deliver? Can you speak to people be it via email or over the phone, and do they respond promptly to your queries, or do you often get left days between responses?

Can they demonstrate they have the basic knowledge and understanding of the sector, to ensure the award is correct for you and your facility, and more importantly that the award or route is achievable?

2) Do the training materials get sent via email? If the answer is YES , then this can often be a red flag, certainly for such an in-depth qualification!

It’s possibly not the end of the world if it’s a 1-day knowledge course, providing an update to your existing knowledge, but when your required to learn such large quantities of information and the question paper assignments take a concentrated amount of effort to complete, how can you continue to research and learn, when the notes you made days or weeks earlier, are just pages of scribbles and don’t link to the information taught on the course?

It shows a lack of understanding of the level and process required to achieve the award, especially with many still working from home or on a phased return, it isn’t always possible to print all the materials required and why should you have to?

3) Have they won any awards in recent times, have they got evidence of positive feedback from their learners and clients? Is this something which you can track and trace? Google there business, this is always a good start point, as you can see any reviews people have left, also consider is the feedback about the qualifications or training or general and more likely be a supplier.

4) Do they have a reputation for just teaching you to pass the qualification? Our courses are packed full of knowledge, as an innovative centre with years of experience we have adapted the knowledge to not only allow you to achieve the award, but it ensures you obtain lots of useful operational knowledge which you can apply to your business, as many things in waste are changing rapidly, far quicker than the qualifications.

Its worth noting that while the learning outcomes for this qualification are set by the awarding body CIWM ( WAMITAB ), each centre develops there own training materials which are then approved by CIWM ( WAMITAB ) before delivery can then commence, and this along with the trainer is what makes each centre unique!

5) Are they approved to deliver this qualification? Waste Exemptions Consultation Outcome - Supplementary Government Response - Updated 6 February 2023

Defra and the Welsh Government published a consultation on “proposals to tackle crime and poor performance in the waste sector and introduce a new fixed penalty for the waste duty of care” (the 2018 consultation).

This focussed on the standard of operator competence at permitted waste sites, reforming the waste exemptions element within the environmental permitting regime to prevent the use of exemptions to cover illegal activity, and introducing a fixed penalty notice for breaches of the household waste duty of care.

This page covers the core reforms to the waste exemptions regime, and the regulators approach to implementing any changes to current exemptions, to include those due to be removed.

Summary of changes:

�� Prohibiting the use of exemption at / adjacent to permitted sites.
�� Limiting the number of exemptions registered at a site.
�� Compulsory requirements for operators to keep and make records available on request.
�� Requirement for operators to keep records in an electronic format.

Exemptions to be removed:

�� U16 – Use of depolluted ELVs for parts
�� T8 – Mechanically treating end-of-life tyres
�� T9 – Recovery of scrap metal

Changes to conditions:

The regulators will stagger the approach to the reforms for the waste exemptions regime. They will include a transitional date by which each exemption will either be removed, or from when the amendments will come into force.

For those waste exemptions to be removed, they will make provision in the regulations for operators to continue operating under their existing exemptions after the transition date, as long as they have submitted a permit application to the regulators before the transition date.

The existing exemption conditions will continue to apply after the transition date, or until the registration of the exemption expires until such time as the permit application is determined. The regulators will set out an approach for managing exemptions where the permit application is incomplete or rejected and will communicate this to industry directly.

For those waste exemptions for which the conditions are to be amended, operators will be able to operate under their existing exemptions (including exemptions that need to be renewed) until the end of the transition period.

At the end of the transition period, all exempt operators must comply with the new conditions, or the operator must have made an application for an environmental permit, or the activities must cease.

New exemptions subject to transitional provisions that are registered after the amendments to the Environmental Permitting Regulations can also operate under the existing exemptions until the end of the transition period.

It is intended that the amendments to the Environmental Permitting Regulations will be made within the next year. Further detail about when the amendments will come into force will be shared in due course.

Future regulatory changes to Exemptions

Through the Environment Act 2021 we will give the regulators the powers to charge for exemptions.

The Environment Act 2021 also gives the regulators powers to amend certain exemption conditions without requiring a legislative change. The details for this will be developed at a later date, but it is considered likely that this will be similar to the existing practice for varying conditions in standard rules permits to reflect changing circumstances and new practices. The intention is to allow a similar flexibility for lower risk exempt activities.

During the next six months the inspectors will be focussing on:

CIWM (WAMITAB) Continuing Competence Test - Additional Security

Additional security requirements for those sitting their continuing competence test!

We thought we would update you to make you aware of a new requirement for those looking to sit their Continuing Competence test.

As of the 3 ^rd of May, learners are required to have their photo taken on the day of their test.

Pearson Vue will store these photos and use them to check identity when a Continuing Competence learner returns for their repeat test every two years, as additional evidence to validate a learner’s identification.

When a learner books their test, they will be asked to confirm that they understand that they will be required to have their photo taken on the day of their test.

On the test day, if learners refuse to have their photo taken, the test centre will not allow them to sit their test.

A copy of the photo will be transferred to CIWM by Pearson Vue but will be securely deleted upon completion of the results notification process. CIWM will not store or use the photo for any other purposes.

Photos will remain securely stored by Pearson Vue until the next time a learner takes a test. A new photo will be taken every time a learner sits their test to ensure up to date identification is stored. Photos taken during previous tests will be deleted and replaced with the new photo.

IMPORTANT Note : CIWM has introduced two new Metal Recycling Contractor Competency Scheme (MRCCS) tests.

If taking a Continuing Competence test, learners must ensure that they select the Continuing Competence test and not the MRCCS test when they next book.

Karen Gooderham should be extremely proud of this achievement, having been in the world of waste for under two years, she has really worked hard to achieve this award with minimal input from the wider centre team, other than the training and feedback provided as part of the process!

Is your CIWM / WAMITAB continuing competence test due? Is this the first time you have sat the test and you’re not sure what to expect?

Let us tell you more…..

The first thing you need to do is book your test, you can do this by visiting the Pearson Vue website - Click Here , creating a new account if this is your first test or simply logging in if you have completed the test before!

Once you have created an account you can book a test at your local Pearson Vue test. Pearson Vue are better known for delivering test's like the driver theory test, so there will be a test centre in most major towns or cities.

So you have booked your test......what can you expect on the day?

The test itself is split into two stages.

Stage one covers 18 generic multiple-choice questions on Legislation, Environmental Protection and Health & Safety. Your required to achieve at least 50% in the generic section of the test.

Stage two is aimed at your specific competency or for those who hold multiple competencies you will have to select and complete an additional test for each specific competency (Please be aware you cannot do any more than three specific tests at any one time).

Each specific test contains 12 multiple-choice questions. You are required to achieve at least 50% in each competency section of the test.

The overall pass mark required is 70% however as above you need to achieve at least the minimum percentage in each stage to pass the test. You would not pass if you were to achieve 18 in the generic but only 2 in the specific competence stage.

To provide a more simplistic idea of the requirements 70% equates to 21 correct responses over the two stages of the test. This is based on someone completing the generic stage and then one additional competency.

2) Check you have the correct competence

Check the activity specific continuing competence test you require, even if you have sat the test before!

Especially if you hold a hazardous treatment award and cover a non-hazardous activity!

The CIWM (WAMITAB) Operator competence scheme, is laid out in a large document that explains how the scheme works, which includes specific requirements surrounding the continuing competence.

What we are about to tell you has always been included in the scheme, but it was never fully enforced until now, and it's certainly something that is being enforced across the country and is certainly impacting new permit applications!

If you have a CIWM (WAMITAB) Qualification for hazardous waste treatment, maybe you're covering an ELV site or non-hazardous treatment and transfer facility? Maybe you hold hazardous transfer and cover a non-hazardous transfer facility?

Make sure you have the appropriate continuing competence!

If you undertake a qualification covering more than one activity, and choose to change activities at a later date (e.g. you have completed MROC2 for end-of-life vehicles and are planning to move to a WEEE-ATF site), you will need to complete the appropriate Continuing Competence test for the new activity.

If you are using a hazardous waste qualification (e.g. HROC6 ) as evidence of technical competence to cover a non-hazardous waste activity (e.g. non-hazardous transfer with treatment ), you need to sit the hazardous waste continuing competence test (e.g. TMH ) to maintain the original award and the corresponding non-hazardous waste continuing competence test (e.g. TMNH ).

Additionally, if you manage either of the following permits: SR2012No14 and SR2015No18 you need to achieve the appropriate continuing competence for both End of Life Vehicles (ELV) and Metal Recycling Sites (MRS).

3) Continuing Competence Refresher training

If you felt confident that you have kept your Knowledge up to date in respect of all the generic requirements of the test or even your specific competency then you probably would not be reading this!

Often people attending for the first time don’t know what to expect, or they feel they haven’t kept themselves up to speed with changes in Legislation and Regulation or other aspects of what the test entails.

So, we provide an interactive two-day training course. Day one covers all the generic elements of the test, Legislation, Environmental Protection and the Health & Safety, and day two covers your activity specific competence or competencies.

This serves three purposes. One , it allows for your Knowledge to be brought back up to date in the relevant subject areas covered.

Two , it provides background and understanding in terms of what’s required during the test and the process to prevent issues such as selecting the wrong competencies when sitting the test.

Three , it provides more certainty that you will PASS.

We have a first attempt pass rate which exceeds 95% of all those who attend.

During the course we can help you book your own test, we will give you dummy tests in a similar format as the actual test. We will provide you with revision documents should you need to revise any further after the course.

Amendment to the Personal Protective Equipment Regs

On 6 April 2022 the Personal Protective Equipment at Work (Amendment) Regulations 2022 (PPER 2022) come into force and amend the 1992 Regulations (PPER 1992).

They extend employers’ and employees’ duties regarding personal protective equipment (PPE) to limb (b) workers.

Duties unchanged but extended

Under PPER 2022, the types of duties and responsibilities on employers and employees under PPER 1992 will remain unchanged but will extend to limb (b) workers, as defined in PPER 2022.

If PPE is required, employers must ensure their workers have sufficient information, instruction and training on the use of PPE.

A limb (b) worker will have the duty to use the PPE in accordance with their training and instruction, and ensure it is returned to the storage area provided by their employer.

The HSE will publish updated guidance incorporating the changes made by PPER 2022 before the Regulations come into force.

What this means for employers

PPER 1992 places a duty on every employer in Great Britain to ensure that suitable PPE is provided to ‘employees’ who may be exposed to a risk to their health or safety while at work.

PPER 2022 extends this duty to limb (b) workers and comes into force on 6 April 2022. Employers need to carefully consider whether the change to UK law apply to them and their workforce and make the necessary preparations to comply.

What this means for limb (b) workers

If a risk assessment indicates that a limb (b) worker requires PPE to carry out their work activities, the employer must carry out a PPE suitability assessment and provide the PPE free of charge as they do for employees.

The employer will be responsible for the maintenance, storage and replacement of any PPE they provide. As a worker, you will be required to use the PPE properly following training and instruction from your employer. If the PPE you provide is lost or becomes defective, you should report that to your employer.

Definitions of limb (a) and limb (b) workers

In the UK, section 230(3) of the Employment Rights Act 1996’s definition of a worker has 2 limbs:

Limb (a) describes those with a contract of employment. This group are employees under the Health and Safety at Work etc Act 1974 and are already in scope of PPER 1992
Limb (b) describes workers who generally have a more casual employment relationship and work under a contract for service – they do not currently come under the scope of PPER 1992

PPER 2022 draws on this definition of worker and captures both employees and limb (b) workers:

‘“worker” means ‘an individual who has entered into or works under –

(a) a contract of employment; or
(b) any other contract, whether express or implied and (if it is express) whether oral or in writing, whereby the individual undertakes to do or perform personally any work or services for another party to the contract whose status is not by virtue of the contract that of a client or customer of any profession or business undertaking carried on by the individual;

and any references to a worker’s contract shall be construed accordingly.’

General duties of limb (b) workers

Generally, workers who come under limb (b):

carry out casual or irregular work for one or more organisations
after 1 month of continuous service, receive holiday pay but not other employment rights such as the minimum period of statutory notice
only carry out work if they choose to
have a contract or other arrangement to do work or services personally for a reward (the contract doesn’t have to be written) and only have a limited right to send someone else to do the work, for example swapping shifts with someone on a pre-approved list (subcontracting)
are not in business for themselves (they do not advertise services directly to customers who can then also book their services directly)

As every employment relationship will be specific to the individual and employer, the precise status of any worker can ultimately only be determined by a court or tribunal.

We thought we would help you all get in the festive spirit with this smooth mulled wine recipe made with figs, sliced clementine and spices, as nothing says Christmas more than glass of mulled wine!

Great for a Christmas party with friends and family!

Ingredients

750ml bottle of red wine
1 sliced clementine
1 cinnamon stick
1 star anise
3 dried figs
4 cloves
3 black peppercorns
50ml brandy

STEP 1

Pour the red wine into a large saucepan. Add the clementine, cinnamon stick, star anise, dried figs, cloves and black peppercorns. Heat very gently until simmering, then turn off the heat.

STEP 2

Fish out the whole spices and peppercorns with a spoon, then stir in the brandy. Ladle into mugs, or heatproof glasses to serve. You could drop in a slice of clementine to each.

An update on the WAMITAB and CIWM Merger

Update on the WAMITAB and CIWM Merger

WAMITAB (the Waste Management Industry Training & Advisory Board) was established in 1989 by CIWM and other waste sector trade bodies. Solely owned by CIWM since 2017, it is a not-for-profit body with charitable status and its own Board of Trustees.

Last year they decided to merge the two organisations and from the 20th of December 2021, CIWM will become the Awarding Organisation and End Point Assessment Organisation for all qualifications and apprenticeships currently offered by WAMITAB .

From the above date all WAMITAB qualifications will be referred to as ‘ CIWM (WAMITAB) Qualifications ’ and Centres offering these qualifications will become ‘ CIWM (WAMITAB) Qualifications Centres .

While the WAMITAB website will remain largely the same in terms of content and style for now, with the exception of logos and a few minor tweaks, their website address will change to ciwmquals.co.uk , appose to wamitab.org.uk .

They have also created two new logo's ( see below ) which will be used across their certificates , documents , presentations , course notes , literature , communications and websites from the 20 ^th of December forward.

They have also created two corresponding logo's ( see below ) which will be used by us to promote our role as an approved CIWM (WAMITAB) Qualifications Centre .

From the 1st January 2022 all Centres and qualifications will be transferred automatically to CIWM , this will include any learners currently registered to achieve their awards with WAMITAB .

What does this mean to you, if your currently registered with WAMITAB ?

1. You will continue to be registered with your Centre to undertake the qualification you are working towards and CIWM will take ownership of your qualification registration and the certification of your qualification on completion.

2. Their contact information will remain the same initially, but we will keep you updated if anything changes.

3. Any certificates issued will be branded as CIWM .

4. Your qualification title will change very slightly, to include CIWM within the title, WAMITAB will also be referenced in brackets in the title. For example, ‘ CIWM (WAMITAB) Level 4 Certificate in Waste and Resource Management ’.

5. CIWM are working closely with key industry stakeholders and the broader sector to ensure that the change in certificate is well recognised, which will include regulators such as the Environment Agency and Natural Resources Wales . Employers and Regulators will still be able to check the validity of your qualification by scanning the QR code on the certificate , which will take you directly to the quartz system used to record learner registration and certification.

6. If you have previously achieved a WAMITAB qualification and require replacement certificates, these will be issued by CIWM .

7. Your personal data, including your contact details, will transfer to CIWM as part of the merger. This information will continue to be used only for the purposes of administering and awarding your qualification , and for confirming your achievement to legitimate parties such as the Environment Agency .

Please note, this does not change the requirement to achieve the appropriate technical competence for a permitted facility , the only thing that has changed is the awarding organisation which will change from WAMITAB to CIWM and minor changes to the scheme itself which previously included both organisations.

Integration plan for CIWM and WAMITAB reaches an important milestone

CIWM has announced that it has recently received recognition as an Awarding Organisation and End Point Assessment Organisation (England) from the educational regulators in England, Wales and Northern Ireland.

This development marks an important milestone in the integration of WAMITAB into CIWM, a move that is intended to strengthen the provision of relevant and fit-for-purpose qualifications, particularly for the resources and waste management sector.

The resource and waste sector will sit at the heart of a post-pandemic green recovery and will play a critical role in helping to achieve the UK government’s ambitious environmental targets in years to come.

They want to ensure that CIWM is positioned to deliver high-quality education, training and qualifications, creating and supporting a skilled workforce that is equipped to deliver the vital transition to a circular economy.

WAMITAB develops and awards qualifications for site and facility operators across the UK to demonstrate competence in line with the sector’s regulatory and permitting regime. It also develops and awards qualifications for those working in cleaning and street cleansing, facilities management, and parking.

As the leading membership organisation for the resources and waste sector, CIWM represents and supports over 5,000 individuals across the UK and overseas.

Through a range of membership products and services, CIWM empowers its members to achieve success and plays a vital role in shaping the future of the sector, ensuring members’ views are represented and that policy development is informed by theoretical and practical understanding and experience.

In recent years, CIWM’s strategy has been to strengthen its focus on developing new and enhanced member services, as well as taking steps to ensure the ongoing commercial sustainability and resilience of the whole organisation.

The closer integration of WAMITAB into CIWM is part of CIWM’s larger mission to unite, equip and mobilise its professional community to lead, influence and deliver the science, strategies, businesses and policies for the sustainable management of resources and waste.

Work on the integration project, and in particular to align the operation and future strategies of both organisations, is well advanced, with both charities now operating from CIWM’s Northampton Business Park head office.

The full merger of the two organisations is expected at the end of 2021, with CIWM taking over the development and awarding of WAMITAB’s portfolio of qualifications in January 2022.

Those with existing WAMITAB qualifications, or those working towards them, will continue to be recognised via CIWM indefinitely, and CIWM is planning to work closely with industry organisations, such as DEFRA, to ensure that employer and employee recognition for qualifications continues to be as strong as it is today.

My WAMITAB Level 4 Journey

My WAMITAB Level 4 Journey - Day 1, Week 1

I started working at HSEC Services in September 2020, as Centre Administrator. I have been working in administration for over 20 years but for the last 10 years I have been in the oil and gas industry.

When it comes to the waste industry, I know nothing! When I had my interview Ben at the time said he would expect me too complete a WAMITAB Level 4 Waste Management qualification.

At the time I was thinking to myself ‘yeah that will be fine’, I can do that, I’ve done NVQ’s’.

I’ve now been with HSEC Services 5 months, doing the day-to-day administration for the centre and its now time to find out more about waste management it’s self and also to start my journey to achieve the WAMITAB Level 4 Certificate in Waste and Resource Management – VRQ qualification.

About 6 weeks ago Ben said to me he was putting me on the VRQ course we had running in February and March. For the week leading up to it I will say it worried me, everything was running through my head, ‘I know nothing about what goes on, on sites. How much am I expected to know’.

The VRQ course is run online, over the course of 5 days, before the course starts you are issued the following:

• Portfolio – 5 Mandatory Units and Optional Unit(s)

• Question Papers

You are sent a Zoom link for the course the week before the course starts.

I will be attending the split course, which will be 3 days in February and the following 2 days in March.

It is the first day and I have my portfolio and question papers, too hand, as well a notepad and pen.

On my course there was 8 of us and there was a good mixture of people from various backgrounds. The Trainer introduced himself and gave a brief outlook of how the course will be run the chosen dates.

The course is done via ‘Power Point Presentation’. Everyone introduces themselves and then it is straight into the first unit.

Over the course of the three days, we covered three full units and half off another, which we will pick up again in March.

The trainer talks you through each slide, makes you aware of information you can access in order to research and learn more on that subject you are covering.

I learnt about a ‘Waste Hierarchy’ and how to apply it to different types of waste, it was interesting to know that all waste operators have to apply this. What I did find a helpful was the Trainer would give you scenarios of when things may happen, this helped me to understand more why things were needed.

I liked the health and safety unit, this was because I knew a bit of the subjects being covered and it was a lot easier for me to pick up bits of information, I may of not known.

One of the things I liked covering was the risk assessments, as this was an easier way to produce them, compared to how I have previously did them.

The administration part which was covered - keeping records and management systems I liked, as this is what I enjoy doing in administration and why I work within administration. I learnt about the different types of permits and the differing rules.

Over the three days, we covered a lot of different elements and if you work on a waste management site, I can see why this is beneficial and people take on this qualification.

I did find the sustainability section hard going.

The course is very intense and there is a lot to take in. Now I have got a 2-week break before I finish the remaining units, I need to start working on the question papers.

Even though I have a year to complete this qualification, I am going to start these early, as I think if I leave it too late, I will forget what I have learnt up on the course, plus the notes I have taken will not make any sense too me! I have started working on a question paper for one of the units and I’m hoping that I will soon be able to submit it for marking.

Not a WASTE of time for HSEC Services at Letsrecycle Live

Health, Safety & Environmental Compliance Services exhibited at Letsrecycle Live between the 22nd and 23rd of May 2019 at the NAEC Coventry.

We are pleased to say there was a great turn out from clients both existing and new and it was great to meet individuals face to face from across the waste and resource management sector.

The event allowed us to network with customers from a range of back grounds to include councils, utilities companies and individuals operating a range a of permitted facilities both hazardous and non-hazardous.

We had a great deal of interest in the WAMITAB Level 4 Certificate in Waste and Resource Management – VRQ as well as the training services we provide which are at the core of the Centre.

Although this was the first Exhibition for Letsrecycle, it was without doubt a great event, which was popular with many as the entire exhibition was purely about waste management.

This allowed for great networking potential for business experts and market leaders from the waste and recycling sector to network and connect as well as generating new leads and meeting customers.

We are looking forward to exhibiting again at the next exhibition which is due to take place in 2021.

Overall the Exhibition was a great success for the Centre which fast growing in popularity due to the bespoke delivery of our training and qualifications.

We never stand still and pride ourselves on being initiative and developing new methods to improve the learning process as well as looking at ways we can support both individuals and companies within the sector before, during and after they use our services.

Having carried out more than 1500 hours of COTC cover in the last two years, a common trend with some of the smaller business’s we have provided services too, is that they often don’t have any form of site inspection routine, and checks are more as and when they spring to mind rather than scheduled.

Carrying on from our last blog where we provided a FREE compliance & review calendar template to assist you to be more compliant, we have produced a basic site inspection and monitoring form.

This form prints off in A4 and is suitable for various types of facilities from small transfer stations to large transfer / treatment facilities.

By implementing a routine and carrying out inspection and monitoring on a regular basis, further improves your compliance and allows you to have an auditable system in place which demonstrates a systematic process of checking and inspecting various aspects of your waste facility. It also helps reduce potential environmental impacts, permit breaches, health & safety breaches as well as a common trend in the last few years, FIRE.

By checking tasks have been completed or items such as firefighting equipment, temperature checks of baled materials and wastes on site, emergency drills, all help towards reducing the likelihood of a fire on site.

Carrying out regular site inspections, allows you to check that tasks have been done, is it available, has a member of staff used and extinguisher or eye wash, and said nothing? When was the last time the interceptor was checked, has it filled with sediment? When was the last time a spill drill or fire drill where carried out?

Fairly common issues on any waste site, which could all be prevented by carrying out regular checks of your facility!

What next?

Download the word document.
Amend the site details, adding in your site’s information.
Amend the title headings for each section in the order you want them.
Walk round your site, looking at what else you want to add, check or ensure is available.

Ensure you :

Prioritise your inspections to ensure they get done, even for a big transfer station it should take not more than a few hours.

Provide feedback on your findings directly to employee’s, or as a group through tool box talks, as communication is vital and boosts moral and their input can have positive effects in terms of helping overcome issues and ensuring measures are implemented fully.

Where time and operational constraints allow, get those who carry out the daily checks and inspections involved as it allows you to gain feedback directly and see how they carry out the task as well as developing new management inspections to include mobile plant and other areas of the business!

We do this not to micromanage or pick fault, we are all human and things do get forgotten or missed. However, by ensuring someone within the management structure is regularly carrying out a routine inspection, ensures we are being proactive! And we more likely to identify issues at an early stage and resolve them, rather than a bigger problem arising out of the blue, which could have been preventable.

In addition, by involving others in the inspection process also develops your team into being more proactive when moving around site and allows you to see how tasks are performed. Does he always do this? Is it a one-man / woman task or does it require two people? All additional thought processes that you identify as you do your inspection’s, which further boosts compliance. This also allows you to identify things you would have not previously noticed, if you decided to pop over with another manager and carry out a task such as checking of an interceptor yourself.

Which in turn allows you to further develop tool box talks, improve risk assessments with real input from the people who do the job or through concerns or issues you have identified.

Once you have a routine, it’s easy!

Plot your review periods, and planned completion date for each area of compliance!

Ensure you:

Spend time setting out the calendar with as many aspects of your business as possible. The more effort you put in at the start means less amendments, and your less likely to miss something which in turn means you will be more compliant!

Set realistic time frames for review periods, space things out to ensure where possible each day, week and month requires you to do only a few additional tasks!

Where possible take it to a professional printer to make it as large as possible, so when you have that two minutes to yourself, you can easily identify what needs to be done.

Compliance can be easy, with a little admin!
