Site Cover

The role of the COTC Holder (TCM Holder) is to advise on legal and policy requirements and minimise environmental and human health risks which could be created by the site. This is usually achieved through the setting up and implementation of a site Environmental Management System and ensuring that the company is operating within the rules of either a standard Rules Permit or a Bespoke Permit.


Section 3.2 of the EA document ‘Technical Competence for Operators of Authorised Waste Facilities, July 2004', specifies the attendance times for the Technically Competent Person.


If you have a requirement for temporary COTC cover on your site for reasons which may include:

  • Not yet gained your own Technical Competence / working towards your own qualification

  • Prospective Permit Holder
  • New entrant to waste industry

Health, Safety & Environmental Compliance Services can provide cover to satisfy the Environment Agency requirements be it short, medium or long-term cover.


While providing cover we will help you run your site in compliance with your environmental permit, help you with Environmental issues, liaise with Environment Agency, help you with Health & safety issues and generally give advice and guidance in relation to running a permitted waste facility.


Site attendance is not required for 100% of the operating hours but ranges from a few hours to a few days depending on your site and the particular permit you hold.


We can provide the required legal cover for your site while at the same time train your staff to gain their own Technical Competence Cover via the recognized routes.

Auditing

Checking up on your waste management contractors is advisable in order for you to comply with your obligations under the Duty of Care for Waste.


The Duty of Care requires that you and anyone else who handles your waste takes whatever steps are reasonable to:


Prevent waste for escaping

Provide a written description of the waste

Transfer waste only to authorised persons.


This audit allows you to evaluate your waste contractors to ensure that you and they comply with the Duty of Care at all stages.


Does the Duty of Care apply to me?


Yes, any person who imports, produces, carries, keeps, treats or disposes of waste or who has control over it as a broker. Such persons are subject to the duty of care in so far as they hold the waste or control what happens to the waste.


Householders are generally exempt from the requirement to produce transfer notes but are now subject to the requirements to deal only with authorised persons.


Employers are liable for the acts and omissions of their employees in respect of the duty of care.

There is a focus by the Environment Agency during 2016 on “Waste Crime” and the penalties can be eye watering for failure to comply with the Duty of Care (Section 34 of the Environmental Protection Act 1990).


Make sure your waste is being passed to bona fida operators.


Protect your reputation and permit by only passing waste to “authorised persons”.


What about Environment Agency Audits?


The Environment Agency carry out audits of permitted facilities to ensure the Duty of Care has been adhered to and that each element of process from transfer note, to disposal or recovery have been followed in accordance with relative legislative requirements.
